Conditions of Participation and Liability
The participant will be particularly aware of the following:

  • surfing is a risky sport
  • There is an increased risk of personal injury, both in the person and in a third party
  • the customer has to follow the instructions of the instructors immediately and unconditionally
  • in the case of unlawful conduct, neither the organizer nor the person liable for damage to property

Prerequisites for participation are good swimming skills and a certain athletic resilience. The participant expressly declares that from the medical point of view, there are no reservations about exercising the sport surfing. We recommend to contact your doctor before the start of the trip.

Everyone who is 18 years of age is entitled to participate in the camp. In the case of a minor, the application has to be made in writing with the consent of the education worker. In this way, the person entitled to education declares his child self-responsible enough to participate in the camp. The organizer MissionToSurf does not supervise under minors, apart from the statutory traffic safety requirements.Participation in the camp and the surf course, as well as the use of all offered services, furthermore the journey and the stay are at the own risk, responsibility and costs of the participant.The organizer accepts no liability for dangers, which are inevitably connected with the sport of waves. The participant takes these risks into account.In addition, the organizer assumes no liability for damage caused to the participant during the exercise of the sport by the fault of other participants or third parties.The student insures to be able to swim for at least 30 minutes, to be physically and mentally in good condition and not to suffer from ailments that can be exacerbated by the waves and their typical dangers and burdens.The organizer accepts no liability for loss and damage to the property of the participant.The participant has to handle the surfing material provided to him carefully and properly. The participant is liable for gross negligent damage and loss.The participant is obligated to report any performance errors immediately to the Campleitung.If other companies are charged with the performance of an event, liability shall be assumed by the respective company for the claims relating to the individual performance.On our part, we assume liability for the conscientious preparation and execution of the camp.The organizer, its shareholders and their staff are only liable for accidents and accidents caused by accidents, insofar as an insurance policy - without taking recourse to the above - is responsible for the damage. Any further liability of the above mentioned persons is excluded for damages of the student and will be taken over by the student for damages of third parties. The exclusion of liability applies irrespective of the legal basis, the date of the loss, the person of the injured party and the injured party, the circumstance of the injurious treatment or the damaging event and its causes and nature.The organizer is insured against liability.

Registration and payment modalities
The registration can be done electronically by e-mail or in writing. It is also made by the participant for all participants listed in the application, for whose contractual obligations the applicant is entitled as for his own obligations. Upon receipt of the registration, the participant will receive an e-mail confirmation from the organizer including the amount of the deposit and the account data. The registration is only effective if the deposit has been received by the organizer.

Vouchers (issued by MissionToSurf)
Vouchers issued by MissionToSurf have no expiration date. A transfer or sale of the voucher to another person is only possible after consultation with MissionToSurf.

Value vouchers (sold by various Internet portals)
Value vouchers issued for the branch in Austria can not be redeemed at the branch office in Portugal. A different agreement can be made by the organizer MissionToSurf Portugal.

Cancellation by the participant
It is possible to withdraw from the course at any time. This must be done in writing. This shall come into force upon arrival at the organizer.

Cancellation charges
The cancellation costs are:

    • up to 1 month before arrival date 40% of the total package price;
    • 1 week before arrival date 70% of the total package price;
    • 90% of the total package price in the last week before the arrival date.
    • up to 3 months before the day of arrival, we charge a processing fee of EUR 25, -If a third party enters into the contract, he and the original participant are liable to the organizer as jointly and severally liable for the travel price.

Cancellation by the participant on reason of Corona Virus

Due to the current situation, we offer the following cancellation conditions to participants who have to cancel due to the corona virus:

  • the surf camp stay (course, accommodation) can be postponed to another date free of charge
  • if the participant can no longer arrive, a voucher will be issued for the cancelation costs (course, accommodation), which is valid indefinitely and can be used as well in our companies in Austria (MissionToSurf, kitesurfing.at)

 

Cancellation by the organizer
The organizer can withdraw at any time for compelling reasons and in this case refund the entire paid travel price (accommodation and surf course). The organizer doesn't pay the travel costs (eg. tickets) because the organizer doesn't sell travels like air flights. The organizer reserves the right to unilaterally cancel the participation by 4 weeks before the reserved event date or course. In this case the interested party is not entitled to any further claims, from which title, against the organizer, except the repayment of the advance payments within 5 banktages from the cancellation by the organizer.The instructions of the organizer are to be followed. In the event of a breach of the law, which may jeopardize the reputation or integrity of the participants or the organizer, the participant may be excluded from the course of the course following an admonition. The participation fee will not be refunded in this case.

Warranty
The participant agrees that the organizer will provide a defect-free service or improper performance in lieu of his entitlement to conversion or price reduction within a reasonable period of time. A remedy can be provided in such a way that the defect is remedied or a substitute or higher value substitute service, which also finds the express consent of the participant, is provided. The defect indication is to be made on the spot with the Campleitung. The organizer can refuse the remedy if it requires a disproportionate effort. The participant is obligated to participate in the event of any incidents of performance within the scope of the statutory provisions, to avoid or reduce any damage. The participant is, in particular, obligated to notify his complaint immediately to the local Campleitung. The latter is responsible for remedying the problem if this is possible.

Exclusion of claims and limitation
The participant has to make claims against the organizer due to insufficient travel services and subsequent impossibilities within one month after the end of the trip. Claims can only be asserted if the participant has not been able to comply with the deadline stated above.

Insurance
The participants themselves are responsible for taking out insurance. A travel cancellation insurance is not included in the price. The conclusion of a travel insurance package is advisable.

Changes in the course of events
Changes can not be excluded. The sequence can be changed especially in the case of weather-related hazards. There is no claim for a return payment by the organizer. A short-term temporal and local transfer of the training can therefore be necessary.

Assertion of claims
The participant can assert claims against the organizer in court only with the competent court in Portugal. Portuguese law is applicable.

Privacy
The use of our website is normally possible without giving personal data. If personal data (for example name, address or e-mail addresses) are collected on our pages, this is always done on a voluntary basis as far as possible. These data will not be passed on to third parties without your express consent.

We would like to point out that the transmission of data on the Internet (for example, by e-mail communication) may present security gaps. A complete protection of the data before access by third parties is not possible.

The use of your data for our own promotional purposes (newsletter) is not excluded. You may object to this use at any time.

Your e-mail address can be used by us to send our newsletters. If you do not want this, please let us know. You can unsubscribe at any time.

Severability clause

The invalidity of individual provisions does not constitute the invalidity of the Reisvertrag or the remaining provisions of the General Terms and Conditions (general terms and conditions).
